I am sending this to you in order to give each of you FIRST SHOT at signing up for this course. It will be limited to ATTORNEYS only. Sorry, but the slots available are too few to expand to expert witnesses, plus our instructors are not interested in training their "competition".
For over 4 years, I have been working to put together a new training course like the one I took in 1996 from Dr. Richard Jensen, Mary McMurray and Dave Fries. It was 40 hours, and covered infrared testing equipment, human physiology, Widmark calculations, basic pharmacokinetics of alcohol, explanation of the internal workings of the Intoxilyzer 5000 as well as the Intoxilyzer 8000, etc. We also cover basic operations of various alcohol screening devices (PBTs), such as the SD-2, Alco-Sensor, etc.
Simulators will also be studied and explained extensively, so that you will understand how proper maintenance and calibration checks can be a vital defense strategy.
Case law and evidentiary foundation issues will be covered, too, including the implications of Crawford v. Washington. We will have extensive lectures by both scientists and attorneys (including myself), plus many hands-on "lab" sessions with the breath machines, as was done in 1996.
Incidentally, I may not be able to obtain any 8000 machines, since CMI has studiously guarded the nest on these devices. We will go over the differences in these devices (as compared to the Intoxilyzer 5000---as well as other breath machines.
I do have access to 6 Intox 5000 breath testing devices, including models of the 64, 66 and 68-00 and 68-01 series. I may be able to obtain two more so that I can expand the class a bit.
Tentatively, I am going to have a new 40-hour training class set for December 1-5 (Wednesday at 8:00 AM through Sunday at 1:00 PM) in ATLANTA.
Dr. A. W. Jones has agreed to come from Sweden as one of our speakers.
His significant studies on alcohol physiology and alcohol pharmacodynamics will be part of the materials.
Also, Jay Zager, an ex-police officer from Florida with extensive hands-on experience (15 years) with BOTH devices who was certified to maintain both devices by CMI will be one of our instructors.
I have an invitation out to Mary McMurray, and hope that she accepts the offer to come here to teach again. If not, I will have at least one additional highly qualified scientist at this program.
This course (as with my 1996 course) will track the recommended 40-hour curriculum of the National Safety Council. However, I doubt that we can get NSC to certify the course. However, the value of my 1996 course was NOT the certificate I received; it was the KNOWLEDGE that I obtained that allowed me to cross-examine the state's breath experts out of their shorts.
Without a doubt, this was the MOST important course I ever took to enhance my trial skills for DUI litigation.
Pursuant to NSC standards, every student will have to pass a written exam on the science and law surrounding breath testing. It may be your hardest exam since the State Bar. I strongly advise that you NOT plan on bringing family and NOT plan to go see local friends during the course, since the preparation and study will likely involve practice and review at night after the course.
I have approximately 16 names already from people who have asked to be included in the course. However, the cost may deter a few people from signing up for the course: $4000 per student, which includes all meals, room and board and the conference facilities. We want all students TOGETHER for this entire 4 & 1/2 day period, to share their trial experiences in and out of the class sessions.
We will have a MAXIMUM of 24 students, due to a recommended 4-students-per machine ratio in the lab sessions. If I can get 2 more machines here, I will expand the course to a maximum of 32 students.
Many of you do not use the 5000 or the 8000. You may ask, "Will there be other courses offered?" The answer is YES, but in 2005. Same format and same limitations. Same price. I intend to sponsor a Datamaster course as well as an EC-IR and Draeger.
We are doing the 5000/8000 course first, since more states use these devices that any other. If we do another one for the 5000/8000, it will likely be a year or more later, and there are NO GUARANTEES that we can duplicate this effort.
